Options for resolving conflicts

Here is the scale of options available ranging from informal to formal, increasing in cost and moving from greater to lessor control.  In making a decision consider factors such as costs, time involved, relationship with the party and your desire for control of the outcome.

  • Negotiation – parties reach an agreement through discussion.
  • Mediation – mediator (third party) facilitates the process, so parties can reach an agreement
  • Judicial settlement – judiciary may offer a non-binding recommendation on how problems should be solved.
  • Arbitrator – chosen by the parties to decide the outcome.
  • Trial – court imposes a decision based on the evidence provided.
